Le Premier ministre,
Sur le rapport du ministre de l'économie, des finances et de l'industrie et du ministre de la fonction publique, de la réforme de l'Etat et de la décentralisation,
Vu la loi no 83-634 du 13 juillet 1983 modifiée portant droits et obligations des fonctionnaires, ensemble la loi no 84-16 du 11 janvier 1984 modifiée portant dispositions statutaires relatives à la fonction publique de l'Etat, et notamment ses articles 79 et 80 ;
Vu l'avis de la commission des statuts du Conseil supérieur de la fonction publique de l'Etat en date du 16 juillet 1998 ;
Le Conseil d'Etat (section des finances) entendu,
Décrète :
APPLICATION DES ART. 79 ET 80 DE LA LOI 83634 DU 13-07-1983.POUR LES AGENTS NON TITULAIRES DU NIVEAU DE LA CATEGORIE A MENTIONNES AUX ART. 73,74 ET 76 DE LA LOI SUSVISEE,LA CONDITION DE TITRES OU DIPLOMES EXIGEE PAR LES DECRETS PRIS POUR L'APPLICATION DES ART. 79 ET 80 DE CETTE LOI EST CONSIDEREE COMME REMPLIE LORSQUE CES AGENTS SATISFONT A L'UNE DES CONDITIONS SUIVANTES:
1: AVOIR ACCEDE A UN EMPLOI D'AGENT NON TITULAIRE DU NIVEAU DE LA CATEGORIE A CONFORMEMENT AUX REGLES DE PROMOTION PREVUES PAR LES DISPOSITIONS QUI LES REGISSENT;
2: AVOIR OBTENU LA VALIDATION DES SERVICES ACCOMPLIS EN QUALITE D'AGENT NON TITULAIRE DU NIVEAU DE LA CATEGORIE A EN EQUIVALENCE DES TITRES OU DIPLOMES REQUIS PAR LES DECRETS MENTIONNES AU 1ER AL. DU PRESENT ARTICLE.
POUR L'APPLICATION DU 2 DE L'ART. 1 CI-DESSUS,DES COMMISSIONS MINISTERIELLES D'EQUIVALENCE SONT CREEES PAR ARRETES CONJOINTS DU MINISTRE CHARGE DE LA FONCTION PUBLIQUE ET DES MINISTRES INTERESSES.
CHAQUE COMMISSION EST PRESIDEE PAR UN REPRESENTANT DU MINISTRE DONT RELEVE LES CORPS DE CATEGORIE A AUXQUELS LES AGENTS NON TITULAIRES CONCERNES ONT VOCATION A ACCEDER.
ELLE COMPREND,OUTRE UN REPRESENTANT DU MINISTRE CHARGE DE LA FONCTION PUBLIQUE ET UN REPRESENTANT DU MINISTRE DE L'EDUCATION NATIONALE,DES REPRESENTANTS DES SERVICES ASSURANT LA GESTION DES FONCTIONNAIRES DES CORPS D'ACCUEIL ET,LE CAS ECHEANT,DES REPRESENTANTS DES SERVICES AU SEIN DESQUELS LES AGENTS NON TITULAIRES EXERCENT LEURS FONCTIONS.CES REPRESENTANTS DOIVENT APPARTENIR A UN CORPS DE FONCTIONNAIRES DE CATEGORIE A.
LES COMMISSIONS SUSMENTIONNEES SE PRONONCENT AU VU DE L'EXPERIENCE PROFESSIONNELLE ET DES TITRES,TRAVAUX ET QUALIFICATIONS DETENUS PAR LES CANDIDATS.
LES AGENTS NON TITULAIRES DU NIVEAU DE LA CATEGORIE A REMPLISSANT LES CONDITIONS DE L'ART. 1 CI-DESSUS ET AYANT VOCATION A ETRE TITULARISES DANS UN DES CORPS MENTIONNES DANS LES TABLEAUX DE CONCORDANCE DES DECRETS DEJA PUBLIES,DONT LA LISTE...
