Le Premier ministre,
Sur le rapport du ministre d'Etat, ministre de l'écologie, de l'énergie, du développement durable et de la mer, en charge des technologies vertes et des négociations sur le climat, du ministre de l'alimentation, de l'agriculture et de la pêche et du ministre du budget, des comptes publics, de la fonction publique et de la réforme de l'Etat,
Vu le code du service national, notamment son article L. 122-16 ;
Vu la loi n° 83-634 du 13 juillet 1983 modifiée portant droits et obligations des fonctionnaires, ensemble la loi n° 84-16 du 11 janvier 1984 modifiée portant dispositions statutaires relatives à la fonction publique de l'Etat ;
Vu l'ordonnance n° 58-1136 du 28 novembre 1958 modifiée portant loi organique concernant les nominations aux emplois civils et militaires de l'Etat ;
Vu le décret n° 82-451 du 28 mai 1982 modifié relatif aux commissions administratives paritaires ;
Vu le décret n° 84-961 du 25 octobre 1984 modifié relatif à la procédure disciplinaire concernant les fonctionnaires de l'Etat ;
Vu le décret n° 85-986 du 16 septembre 1985 modifié relatif au régime particulier de certaines positions des fonctionnaires de l'Etat et à certaines modalités de cessation définitive de fonctions ;
Vu le décret n° 94-874 du 7 octobre 1994 modifié fixant les dispositions communes aux stagiaires de l'Etat et de ses établissements publics ;
Vu le décret n° 2001-622 du 12 juillet 2001 relatif à la formation des élèves de l'Ecole polytechnique ;
Vu le décret n° 2004-1105 du 19 octobre 2004 relatif à l'ouverture des procédures de recrutement dans la fonction publique de l'Etat ;
Vu le décret n° 2005-1090 du 1er septembre 2005 relatif à l'avancement de grade dans les corps des administrations de l'Etat ;
Vu le décret n° 2007-196 du 13 février 2007 relatif aux équivalences de diplômes requises pour se présenter aux concours d'accès aux corps et cadres d'emplois de la fonction publique ;
Vu le décret n° 2008-370 du 18 avril 2008 organisant les conditions d'exercice des fonctions, en position d'activité, dans les administrations de l'Etat ;
Vu l'avis du comité technique paritaire ministériel du ministère de l'écologie, de l'énergie, du développement durable et de l'aménagement du territoire en date du 4 décembre 2008 ;
Vu l'avis du comité technique paritaire ministériel du ministère de l'agriculture et de la pêche en date du 15 janvier 2009 ;
